1. About These Terms

These Terms of Service ("Terms") govern your use of transformwithtoska.com and all services offered by Transform with Toska, operated by Toska trading as Transform with Toska, a VAT-registered business based in the United Kingdom ("we", "us", "our").

By purchasing a product or service, joining the Many Butterflies community, or using our website, you agree to these Terms. These Terms are governed by the laws of England and Wales.

2. Our Services

  • Live workshops delivered online (including I Choose Me and future workshops)
  • Online programmes and courses delivered over a fixed period
  • Many Butterflies: a paid, moderated community private membership hosted on Telegram
  • A free newsletter

3. Purchasing Services

3.1 Workshops and Programmes

When you purchase a workshop or programme, you are purchasing access to a specific scheduled live event or course. Prices are shown on the relevant product page. All prices are in GBP or USD as displayed. UK customers will be charged applicable VAT.

3.2 Community Membership

Many Butterflies is a monthly subscription beginning on the date of your first payment, renewing monthly until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.

3.3 Payment

Payments are processed by Apple Pay, Stripe (card) or GoCardless (direct debit). By completing a purchase you authorise us to charge the stated amount. For subscriptions, you authorise recurring charges until you cancel.

4. Cancellations and Refunds

4.1 Workshops and Programmes

If you cancel at least 7 days before a scheduled workshop, you are entitled to a full refund. Cancellations within 7 days are not eligible for a refund. If we cancel or significantly reschedule an event, you will receive a full refund.

4.2 Community Membership

You may cancel at any time. We do not offer pro-rata refunds for unused portions of a monthly billing period. On cancellation you retain access until the end of the period you have paid for.

4.3 Statutory Rights

Nothing in these Terms affects your statutory rights under UK consumer law, including the Consumer Contracts Regulations 2013.

5. Session Recordings

Whether a session is recorded and whether recordings are made available to participants is stated clearly on the product page at the point of purchase. Check the product page before purchasing if replay access is important to you.

Where replay access is stated as included, we will make a recording available within 5 business days of the live session. Replays are accessible only to enrolled participants through our secure member portal. You may not share, redistribute, or make recordings available to third parties under any circumstances.

Live workshops are not recorded unless explicitly stated. Purchasing a live workshop gives you access to attend the scheduled session only.

6. Community Rules (Many Butterflies)

By joining Many Butterflies you agree to: treat all members with respect; keep community content confidential; not share, screenshot, or redistribute other members' content without permission; not use the community for commercial promotion or spam; not post harmful, discriminatory, abusive, or unlawful content. We reserve the right to remove any member who violates these rules without refund.

7. Acceptable Use and Conduct

We are committed to keeping every space we run safe, respectful and supportive. This section applies to all of our services and to every way you interact with us, including our workshops, our programmes, the Many Butterflies community, live sessions, email, direct messages and any support channel.

When using our services or communicating with us, you agree that you will not:

  • abuse, harass, threaten, bully, intimidate or demean any person, including Toska, our facilitators, our team, our contractors and other participants or members;
  • post, send or share content that is harmful, discriminatory, hateful, defamatory, sexually explicit, harassing or unlawful;
  • disrupt a live session, programme or community space, or behave in a way that interferes with others taking part;
  • contact us or any member through unwanted, repeated or aggressive communication;
  • impersonate any person or misrepresent your identity or affiliation.

This standard applies equally to behaviour directed at Toska, at our facilitators and team, and at other participants and members.

If you breach this section, or behave in a way we consider abusive, threatening or inappropriate, we may, at our discretion: issue a warning; remove you from a live session, programme or community; suspend or terminate your access to any or all of our services; and decline to provide you with services in the future. Where we remove or terminate your access for such behaviour, we may do so without a refund. Decisions about removal and termination, including whether a refund is given, are made at the sole discretion of Transform with Toska management.

Nothing in this section affects your statutory rights under UK consumer law that cannot be excluded or limited.

8. Intellectual Property

All content on our website, in our programmes, workshops, and community - including written content, frameworks, and methodology - is owned by Transform with Toska and protected by copyright. No commercial reproduction, distribution or use is permitted without prior written permission.

9. Not Professional Advice

Our content is educational and does not constitute therapy, clinical psychology, medical, legal, or financial advice. In a mental health crisis: contact a professional, dial 999, or call Samaritans on 116 123.

10. Disclaimer of Warranties

To the fullest extent permitted by law, our services are provided “as is” and “as available” without any express or implied warranty. We expressly exclude all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that services will be uninterrupted, error-free, or that results will meet your requirements. Nothing here affects consumer rights under UK law that cannot be excluded.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, consequential, incidental, special, or punitive loss or damage, including loss of profits, data, goodwill, or business interruption. Our total aggregate liability shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim. Nothing limits our liability for death or personal injury from negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Transform with Toska, Toska herself, and all employees, contractors, and agents from any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from: your use of our services; your violation of these Terms or any applicable law; your violation of any third-party rights; content you submit through our services or community; or any dispute between you and another community member.

13. Events Beyond Reasonable Control

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, government action, power or internet outages, strikes, or failures of third-party services including Zoom, Telegram and Stripe. If a force majeure event prevents delivery of a paid session, we will offer a rescheduled date or a full refund at your election.

14. Changes to Services and Terms

Material changes notified by email with reasonable notice. Continued use after the effective date constitutes acceptance. Where a paid service is discontinued before delivery, we will issue a full refund.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision is found invalid or unenforceable, it shall be limited to the minimum extent necessary so remaining provisions continue in full force.

17. Entire Agreement

These Terms, together with our Privacy Policy and AI and Data Statement, constitute the entire agreement between you and Transform with Toska and supersede all prior agreements, written or oral.

18. Waiver

No failure or delay in exercising any right operates as a waiver. A waiver of any breach is not a waiver of any subsequent breach.
